Website Terms of Use

These Website Terms of Use (hereinafter, the “Terms”) govern access to and use of the “Entry Portal for Industrial Research explOitation” (EPIRO), temporarily hosted at the URL https://prp-ri.eu/ (hereinafter, the “Website”), including all sections and areas reserved for registered users. The Website is managed by Area di Ricerca Scientifica e Tecnologica di Trieste – Area Science Park (hereinafter, “Area Science Park”), with its registered office at Località Padriciano 99, 34149 Trieste, Italy, VAT No. 00531590321.

In welcoming you to the Website, we invite you to carefully read these Terms before proceeding with access to or use of the Website. These Terms apply to all visitors and/or users of the Website (hereinafter, “Users” or, individually, a “User”). By accessing or using the Website, you confirm your acceptance of these Terms and agree to be bound by them. If you do not accept these Terms, please discontinue use of the Website immediately.

1. Purpose and Content of the Website

The Website is intended to:

  • provide information regarding the scientific and technical services offered by the distributed and interoperable research infrastructure “Pathogen Readiness Platform for CERIC-ERIC upgrade” (hereinafter, “IR PRP@CERIC”), as listed in the catalog of experimental and computational resources available in the “Catalog” section of the Website; and
  • serve as an access channel to the aforementioned services.

IR PRP@CERIC is established and managed by Area Science Park jointly with the following entities:

  • National Research Council (Consiglio Nazionale delle Ricerche – CNR), with headquarters at Piazzale Aldo Moro 7, Rome, through: the Institute of Crystallography, located at Via Giovanni Amendola 122/O, Bari and the Institute of Materials (Officina dei Materiali), located at S.S. 14 Km 163.5, Basovizza, Trieste;
  • University of Salerno, with headquarters at Via Giovanni Paolo II 132, Fisciano (Salerno);
  • University of Salento, with headquarters at Piazza Tancredi 7, Lecce;
  • University of Naples Federico II, with headquarters at Corso Umberto I 40, Naples;
  • Elettra-Sincrotrone Trieste S.C.p.A., with headquarters at Strada Statale 14, km 163.5, Area Science Park, Basovizza, Trieste.

For each service offered through the Website, the relevant Operational Unit or Platform managed by the entity that bears sole responsibility for providing that specific service is indicated, under the conditions and terms that will be made available to the User during the pre-contractual phase.

Area Science Park, in its capacity as the operator of the Website, assumes no liability toward Users for the correctness, completeness, accuracy, or timeliness of the information contained on the Website, including, by way of mere example, service descriptions and/or indications of service availability, except in cases of willful misconduct or gross negligence on its part and except where otherwise provided by law. From time to time, Area Science Park may modify or remove, temporarily or permanently, certain services and their related features and specifications made available through the Website, including without prior notice of such changes.

2. Terms for Use of the Website

Use of the Website is free of charge.

Registration, access to, and use of the Website are permitted only to users who have reached the age of majority under Italian law (i.e., 18 years of age or older). Any use of the Website by minors presupposes and implies the authorization and supervision of their parents or of the person exercising parental responsibility or legal guardianship over them. Such persons shall therefore assume full responsibility for the minor’s actions toward Area Science Park and any third parties involved in any capacity.

The User is fully and exclusively responsible for the use of the Website (with express reference to its functions for transmitting data and information) and is therefore solely responsible for the accuracy, completeness, and lawfulness of the content transmitted by the User.

By way of example only and without limitation, the User undertakes, in particular, to:

  • not misrepresent or falsify their identity;
  • not use the Website to transmit unlawful, vulgar, obscene, slanderous, defamatory, offensive, or otherwise objectionable material, or any content that infringes the rights of others or is intended to facilitate, encourage, or enable criminal acts or unlawful conduct in general;
  • use appropriate language in compliance with the law and ethical standards, and refrain from transmitting content that is contrary to public order, public decency, and/or morality;
  • not transmit false or misleading content;
  • not transmit content containing viruses or other systems intended to damage or interfere with the operation of the Website;
  • refrain from any unlawful processing of personal data;
  • not use the Website in any manner that infringes intellectual property rights, privacy rights, or any other personal or proprietary rights of Area Science Park or third parties;
  • not interfere with or impair other Users’ use and enjoyment of the Website;
  • ensure that they are aware of and comply with all applicable mandatory laws and regulations currently in force, as well as these Terms and Conditions.

Without prejudice to the fact that any unlawful conduct will be reported to the competent law enforcement authorities, the User assumes full responsibility in the event of any claim by third parties concerning any content or conduct attributable to the User and undertakes to indemnify and hold Area Science Park unharmed from and against any damage, loss, cost, expense, claim, and/or action arising therefrom, including those brought by third parties.

Should the User disclose personal data relating to third parties, the User warrants that such disclosure is based on an appropriate legal basis for the lawful processing of such data and assumes all related obligations and responsibilities under applicable law. The User agrees to indemnify and hold Area Science Park harmless from any objection, claim, or request for compensation arising from the processing of such data that the data subjects may bring against Area Science Park.

The User further undertakes to inform the data subjects whose personal data are disclosed of the information contained in the Privacy Policy, Cookie Policy, and any notices made available on the Website that may be relevant to them.

The User also undertakes not to make improper use of any contact details available on the Website for any purpose. By way of example and without limitation, the sending of advertising or promotional material, or any other form of unauthorized or unsolicited solicitation by email or through any other means of contact, is prohibited.

The content published on the Website is intended exclusively for the Website’s Users. Reuse of such content outside the Website is permitted provided that the source of the reused data and/or information is properly acknowledged.

3. Processing of Personal Data

With regard to the processing of the personal data of Website Users, reference is made to the Website’s Privacy Policy and Cookie Policy, as well as to the privacy notices provided to the User when completing any contact form available on the Website or when registering on the Website itself.

4. User Content

Area Science Park and the other entities referred to in Section 1 reserve the right to view, store, archive, and copy any content, data, information, and, more generally, any material of any kind submitted by the User through the Website (hereinafter collectively referred to as the “User Content”).

In light of the foregoing, Area Science Park and the other entities referred to in Section 1 undertake, also on behalf of their employees and/or collaborators, as well as any third parties involved in activities instrumental and/or related to the provision of the services requested by the User, to keep such User Content confidential.

Where particular requirements of secrecy, confidentiality, and/or non-disclosure apply to the User Content, each User may request that such content be protected through the execution of an appropriate Non-Disclosure Agreement (NDA) with the parties who will have access to or use the content in any capacity.

5. Third-Party Content

The Website may include, use, or display content created by third parties, information obtained from public sources, and/or links to external websites or web pages managed by third parties, including the entities referred to in Section 1 (hereinafter referred to as “Third-Party Content”).

Area Science Park does not exercise any control over or monitor Third-Party Content and therefore assumes no responsibility for the accuracy, security, or reliability of such content. Area Science Park cannot and does not guarantee that Third-Party Content is free from viruses or other features capable of damaging Users’ data and/or property.

Any links or references to Third-Party Content connected to the Website do not constitute, and shall not be interpreted in any way as, an endorsement by Area Science Park of the Third-Party Content to which such links or references relate.

Access to any Third-Party Content is at the User’s own risk, and Area Science Park disclaims all liability for any loss or damage that Users may incur (including, by way of example, any loss of or damage to computer equipment, hardware, or software) arising from or connected with Users’ access to, use of, or reliance upon any Third-Party Content.

Whenever Users access such Third-Party Content, in any manner and for any purpose, Area Science Park encourages them to promptly review the terms and conditions governing the use of that Third-Party Content.

6. Warranties

Users acknowledge and agree that their use of the Website is entirely at their own risk and that they assume full and exclusive responsibility for their use of the Website and its contents, including Third-Party Content (hereinafter collectively referred to as the “Content”).

Area Science Park takes all necessary measures to reduce, as far as reasonably possible, the risk that the Website and its Content may contain viruses or defects. However, Area Science Park cannot guarantee that, when Users access or use the Website and/or its Content, their computer systems, hardware, software, or any data generated or stored by such systems, hardware, or software will not be damaged, lost, or otherwise adversely affected.

Accordingly, Users assume full responsibility for any damage that may result to their information technology systems from the use of the Website. Users are responsible for providing the technological, IT, and telecommunications means necessary to access the Website, acquiring the skills required to access and use the Website and its Content, and bearing all related costs and expenses  Furthermore, Area Science Park makes no warranty that  the Website, including its Content, services, and functionalities, will operate without interruption, any defects identified in the Website will be corrected, or the Users’ use of the Website will produce any specific result.

The Website and its Content are provided “as is” and “as available”. In addition, Area Science Park disclaims all warranties, whether express or implied, including any warranty of accuracy, completeness, non-infringement of third-party rights, merchantability, or fitness for a particular purpose.

Finally, any link to the Website made available from other websites does not constitute approval or endorsement by Area Science Park of such websites or their content, nor does it imply any form of warranty by Area Science Park, which therefore assumes no responsibility in this regard.

7. Limitation of Liability

Area Science Park reserves the right to modify, suspend, or discontinue, in whole or in part, the availability of the Website at any time, including without prior notice and without any obligation to provide the reasons for such actions.

To the fullest extent permitted by applicable law, Area Science Park shall in no event be liable to Users or third parties for any loss or damage arising from the use of the Website and/or its Content, any information contained on the Website, or any services offered through it, including, by way of example: (a) loss of or damage to data; (b) loss of or damage to the Users’ technological equipment, computer systems, hardware, or software; (c) loss or damage suffered by Users as a consequence of their failure to take reasonable precautions against such loss or damage, such as installing appropriate antivirus protection.

Area Science Park further disclaims all liability for any indirect damages, regardless of their cause, origin, nature, or consequences, including, by way of example and without limitation, costs incurred due to loss of opportunities, loss of data, or any other loss of tangible or intangible assets resulting from the use of the Website, the inability to use the Website, or reliance placed on information made available directly or indirectly through the Website.

Nothing in these Terms shall exclude or limit Area Science Park’s liability toward Users in cases of willful misconduct, gross negligence, or any other liability that cannot be excluded or limited under applicable law. By using the Website, Users agree that, if they are dissatisfied with the Website and/or any provision of these Terms, their sole and exclusive remedy is to discontinue use of the Website.

Area Science Park disclaims all liability relating to the acts, omissions, and conduct of third parties in connection with Users’ use of the Website, including, by way of example only, liability arising from third-party content, information, or statements made available on or through the Website, or resulting from defamation, infringement of intellectual property rights, privacy rights, or other applicable laws committed by third parties.

Users further agree to indemnify and hold Area Science Park harmless from any legal action, claim, complaint, and any related damages and expenses, including legal fees, arising out of or connected with any improper and/or unlawful use of the Website and/or its Content by the Users.

8. Governing Law and Jurisdiction

The relationship between Area Science Park and the Users of the Website shall be governed by Italian law, in accordance with which these Terms shall also be interpreted. Without prejudice to any mandatory provisions of law, the courts of Trieste, Italy, shall have exclusive jurisdiction over any dispute concerning these Terms and the relationships governed by them.

9. Validity and Amendments to the Terms of Use

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to render it lawful, valid, or enforceable, while the remaining provisions shall remain in full force and effect.

Area Science Park reserves the right to amend, update, or remove, in whole or in part, these Terms at any time and without prior notice. Any amendments or updates to the Terms shall become binding as soon as they are published on the Website. Users are therefore encouraged to regularly review the Website for the most recent version of the Terms. If Users do not agree with any such amendments, they are invited to cease accessing or using the Website. Continued access to or use of the Website after publication of the amended Terms shall constitute acceptance of those amendments by the Users.
