Condizioni di utilizzo di EPIRO

Le presenti Condizioni di utilizzo di EPIRO (di seguito “Condizioni”) si applicano a chiunque decida di utilizzare il sito web denominato “EPIRO”, raggiungibile al link https://prp-test.promoscience.com/ (di seguito anche “Sito”).

1. Finalità e contenuti del Sito

Area di Ricerca Scientifica e Tecnologica di Trieste – Area Science Park (di seguito “Area Science Park”), ente pubblico nazionale di ricerca con sede legale in Trieste, Padriciano 99, C.A.P. 34149, mette a disposizione di ricercatori e altri professionisti operanti presso imprese, università, enti pubblici di ricerca o strutture scientifiche pubbliche e private un sito web, denominato “EPIRO”, raggiungibile al link https://prp-test.promoscience.com/. Il Sito ha lo scopo di:

fornire informazioni in merito ai servizi offerti dall’infrastruttura di ricerca “Pathogen Readiness Platform for CERIC-ERIC upgrade” (PRP@CERIC);
costituire un canale di accesso ai servizi succitati, nei termini e alle condizioni riportati nella documentazione resa disponibile nelle pertinenti sezioni del Sito medesimo.

2. Titolarità del Sito

Area Science Park è titolare del Sito, nonché di tutti i diritti inerenti e conseguenti allo sfruttamento del medesimo.

3. Applicabilità delle Condizioni

Le presenti Condizioni si applicano agli utenti che interagiscono col Sito compilando uno dei form di contatto presenti su di esso e/o registrandosi al Sito medesimo e/o richiedendo l’accesso ai servizi offerti dall’infrastruttura di ricerca “Pathogen Readiness Platform for CERIC-ERIC upgrade” (PRP@CERIC)(di seguito “Utente/i”).

4. Termini per l’utilizzo del Sito

L’utilizzo del Sito è gratuito.

La registrazione, l’accesso e la fruizione del Sito sono consentiti unicamente a Utenti maggiorenni secondo la legge italiana (ossia, maggiori di anni 18). L’eventuale utilizzo del Sito da parte di Utenti minorenni presuppone e sottintende l’autorizzazione e la supervisione dei genitori o di chi ne esercita la responsabilità genitoriale o la tutela legale, i quali assumeranno quindi ogni responsabilità rispetto all’operato del minore nei confronti di Area Science Park e dei terzi a ogni titolo coinvolti.

L’Utente si impegna, altresì, a non fare un utilizzo improprio dei contatti presenti a qualunque titolo sul Sito; a titolo esemplificativo e non esaustivo, è vietato l’invio di pubblicità o di materiale promozionale, o qualsiasi altra forma di sollecitazione non autorizzata o non richiesta tramite e-mail o con qualsiasi altro metodo di contatto.I contenuti pubblicati sul Sito sono riservati agli Utenti del Sito stesso. Il loro riuso al di fuori del Sito medesimo è, pertanto, consentito unicamente quando si tratti di dati e/o informazioni di dominio pubblico.

5. Trattamento dei dati personali

Con riferimento al trattamento dei dati personali degli Utenti del Sito, si rinvia alla Privacy Policy e alla Cookie Policy del Sito medesimo, nonché alle informative sul trattamento dei dati personali rilasciate all’Utente al momento della compilazione di ciascun form di contatto presente sul Sito ovvero al momento della registrazione al Sito stesso.

6. Obblighi e responsabilità dell’Utente

L’Utente è pienamente ed esclusivamente responsabile dell’uso del Sito (da intendersi espressamente riferito alle funzioni di trasmissione di dati e informazioni)) ed è pertanto l’unico responsabile della correttezza, completezza e liceità dei contenuti da egli stesso trasmessi.

A mero titolo esemplificativo e non esaustivo, l’Utente si impegna, in particolare, a:

non falsificare la propria identità;
non utilizzare il Sito per la trasmissione di materiale illecito, volgare, osceno, calunnioso, diffamatorio, offensivo della morale corrente, o, comunque, lesivo dei diritti altrui o atto alla commissione, al favoreggiamento e/o all’agevolazione di azioni criminali e di comportamenti illeciti in generale;
utilizzare un linguaggio consono, nel rispetto della legge e dell’etica, nonché ad astenersi dalla trasmissione di contenuti contrari all’ordine pubblico, al buon costume e/o alla morale;
non trasmettere contenuti mendaci;
non trasmettere contenuti recanti virus o altri sistemi tesi a danneggiare il funzionamento del Sito;
astenersi da qualsivoglia trattamento illecito di dati personali;
non utilizzare il Sito in maniera tale da violare diritti di proprietà intellettuale, di riservatezza o qualsiasi altro diritto personale o patrimoniale di Area Science Park o di terzi;
non pregiudicare l’uso e il godimento del Sito da parte degli altri Utenti;
avere cura di conoscere e di rispettare qualsivoglia disposizione legislativa di carattere cogente attualmente in vigore, nonché le presenti Condizioni, che accetta e riconosce di dover visionare prima dell’utilizzo del Sito a qualsiasi scopo.

Fermo restando che eventuali illeciti saranno notificati alle forze dell’ordine, l’Utente assume la piena responsabilità in caso di contestazione da parte di terzi riguardo a qualsiasi contenuto o condotta ad esso legata e si impegna a tenere manlevata e indenne Area Science Park da qualsiasi danno, perdita o spesa, nonché da qualsiasi pretesa e/o azione al riguardo, anche di terzi.

L’Utente, inoltre, si assume ogni responsabilità per eventuali danni che possano derivare al suo sistema informatico dall’uso del Sito.

Qualora l’Utente comunichi dati personali di soggetti terzi, l’Utente stesso garantisce di poter effettuare tale comunicazione sulla base di un’idonea base giuridica per il trattamento lecito dei dati medesimi e si assume tutti i relativi obblighi e responsabilità ai sensi della normativa vigente, tenendo indenne e manlevata Area Science Park rispetto a qualsiasi contestazione, pretesa o richiesta di risarcimento del danno derivante dal trattamento che gli interessati dovessero avanzare nei confronti di Area Science Park stessa. L’Utente si impegna, altresì, a portare a conoscenza degli interessati i cui dati personali siano comunicati le informazioni contenute nella Privacy Policy, nella Cookie Policy e nelle informative di cui sopra che siano di loro interesse.

7. Limitazione di responsabilità

Il Sito è disponibile alla pagina https://prp-test.promoscience.com/ e non è accessibile da altri siti Internet o applicazioni che non siano sotto il controllo di Area Science Park. Si avverte che la pubblicazione del predetto link su altri siti web non comporta necessariamente l’approvazione o l’avallo da parte di Area Science Park dei relativi siti e dei loro contenuti, né implica alcuna forma di garanzia da parte di quest’ultima, che pertanto non si assume alcuna responsabilità al riguardo.

8. Limitazioni nella messa a disposizione del Sito

Area Science Park si riserva il diritto di modificare, sospendere o interrompere, in tutto o in parte, la disponibilità del Sito in qualsiasi momento, anche senza preavviso, e senza che la stessa sia tenuta a indicare le ragioni sottese alle predette azioni.

Area Science Park non potrà parimenti essere ritenuta responsabile dei danni conseguenti alla mancata disponibilità del Sito a causa dell’errato o mancato funzionamento dei mezzi elettronici di comunicazione per cause estranee alla sfera del proprio prevedibile controllo, quali, a titolo esemplificativo e non esaustivo, il malfunzionamento dei server e altri dispositivi elettronici, il malfunzionamento dei software installati, virus informatici, nonché azioni di hacker o altri Utenti aventi accesso alla rete.

9. Legge applicabile e foro competente

I rapporti tra Area Science Park e gli Utenti del Sito sono regolati dalla legge italiana, in base alla quale anche le presenti Condizioni dovranno essere interpretate.

Salvo quanto disposto da norme di legge non derogabili, il Tribunale di Trieste sarà competente in via esclusiva a dirimere ogni controversia riguardante le presenti Condizioni e i rapporti dalle stesse regolati.

10. Validità delle presenti Condizioni

Area Science Park potrà modificare o semplicemente aggiornare, in tutto o in parte, le presenti Condizioni, anche in considerazione della modifica delle norme di legge o di regolamento applicabili. Le modifiche e gli aggiornamenti delle Condizioni saranno vincolanti non appena pubblicate sul Sito: gli Utenti sono, pertanto, invitati a verificare con regolarità la pubblicazione delle più recenti e aggiornate Condizioni.

Terms of Use for EPIRO

These Terms of Use for EPIRO (hereinafter “Terms”) apply to anyone who decides to use the website named “EPIRO”, accessible at the link https://prp-test.promoscience.com/ (hereinafter also the “Site”).

1. Purpose and content of the Site

Area di Ricerca Scientifica e Tecnologica di Trieste – Area Science Park (hereinafter “Area Science Park”), a national public research organisation with its registered office in Trieste, Padriciano 99, ZIP code 34149, makes available to researchers and other professionals working in companies, universities, public research bodies or public and private scientific institutions a website named “EPIRO”, accessible at the link https://prp-test.promoscience.com/.
The Site is intended to:

· provide information on the services offered by the research infrastructure “Pathogen Readiness Platform for CERIC-ERIC upgrade” (PRP@CERIC);

· act as an access channel to the aforementioned services, under the terms and conditions set out in the documentation made available in the relevant sections of the Site.

2. Ownership of the Site

Area Science Park is the owner of the Site, as well as of all rights related to and arising from its use and exploitation.

3. Applicability of the Terms

These Terms apply to users who interact with the Site by completing one of the contact forms available on it and/or by registering on the Site and/or by requesting access to the services offered by the research infrastructure “Pathogen Readiness Platform for CERIC-ERIC upgrade” (PRP@CERIC) (hereinafter the “User(s)”).

4. Terms for use of the Site

Use of the Site is free of charge.

Registration, access to and use of the Site are permitted only to Users who are of legal age under Italian law (i.e. over 18 years of age). Any use of the Site by minor Users presupposes and implies the authorisation and supervision of parents or legal guardians, who shall assume full responsibility for the minor’s actions towards Area Science Park and any third parties involved in any capacity.

The User also undertakes not to misuse the contact details available on the Site for any purpose; by way of example and not limitation, the sending of advertising or promotional material, or any other form of unauthorised or unsolicited solicitation via e-mail or any other contact method, is prohibited.
The content published on the Site is reserved for the Users of the Site. Its reuse outside the Site is therefore permitted only where such content consists of data and/or information in the public domain.

5. Processing of personal data

With regard to the processing of Users’ personal data, reference is made to the Site’s Privacy Policy and Cookie Policy, as well as to the information notices provided to the User when completing each contact form available on the Site or upon registration on the Site.

6. User obligations and responsibilities

The User is fully and exclusively responsible for the use of the Site (expressly understood as including the transmission of data and information) and is therefore solely responsible for the accuracy, completeness and lawfulness of the content transmitted.

By way of example and not limitation, the User undertakes in particular to:

· not falsify their identity;

· not use the Site to transmit unlawful, vulgar, obscene, slanderous, defamatory material, material offensive to public morality or, in any case, material harmful to the rights of others or intended to commit, facilitate or encourage criminal acts or unlawful conduct in general;

· use appropriate language, in compliance with the law and ethical standards, and refrain from transmitting content contrary to public order, decency and/or morality;

· not transmit false or misleading content;

· not transmit content containing viruses or other systems intended to damage the functioning of the Site;

· refrain from any unlawful processing of personal data;

· not use the Site in a manner that infringes intellectual property rights, confidentiality rights or any other personal or proprietary rights of Area Science Park or third parties;

· not impair the use and enjoyment of the Site by other Users;

· be aware of and comply with any mandatory legal provisions currently in force, as well as with these Terms, which the User acknowledges having to review prior to using the Site for any purpose.

Without prejudice to the reporting of any unlawful conduct to the competent authorities, the User assumes full responsibility in the event of claims made by third parties in relation to any content or conduct attributable to the User and undertakes to indemnify and hold Area Science Park harmless from any damage, loss or expense, as well as from any claim and/or action, including those brought by third parties.

The User also assumes all responsibility for any damage that may be caused to their computer systems as a result of using the Site.

Where the User communicates personal data relating to third parties, the User guarantees that such communication is based on an appropriate legal basis for the lawful processing of such data and assumes all related obligations and responsibilities in accordance with applicable legislation, indemnifying and holding Area Science Park harmless from any claim, complaint or request for compensation that the data subjects may bring against Area Science Park as a result of such processing. The User also undertakes to inform the data subjects whose personal data are communicated of the information contained in the Privacy Policy, Cookie Policy and the above-mentioned information notices, insofar as relevant to them.

7. Limitation of liability

The Site is available at https://prp-test.promoscience.com/ and is not accessible from other websites or applications not under the control of Area Science Park. The publication of the aforementioned link on other websites does not necessarily imply approval or endorsement by Area Science Park of such websites or their content, nor does it imply any form of guarantee on the part of Area Science Park, which therefore assumes no responsibility in this regard.

8. Limitations on the availability of the Site

Area Science Park reserves the right to modify, suspend or discontinue, in whole or in part, the availability of the Site at any time, even without prior notice, and without being required to state the reasons for such actions.

Area Science Park shall not be liable for any damage resulting from the unavailability of the Site due to malfunction or failure of electronic communication systems for reasons beyond its foreseeable control, including, by way of example and not limitation, server malfunctions or failures, malfunctioning software, computer viruses, or actions by hackers or other Users with access to the network.

9. Governing law and jurisdiction

The relationship between Area Science Park and the Users of the Site is governed by Italian law, under which these Terms shall also be interpreted.

Unless otherwise provided by mandatory provisions of law, the Court of Trieste shall have exclusive jurisdiction over any dispute concerning these Terms and the relationships governed by them.

10. Validity of these Terms

Area Science Park may amend or update, in whole or in part, these Terms, including in consideration of changes to applicable laws or regulations. Amendments and updates to the Terms shall be binding as soon as they are published on the Site. Users are therefore invited to regularly check the Site for the most recent and updated version of the Terms.
